OHS can prevent psychosocial injury. Employers have a duty of care to identify and control hazards and risks associated with workplace bullying.
New powers of health and safety representatives
On 22 September 2021 powers of HSRs under Part 7 of the Occupational Health and Safety Act 2004 (OHS Act) were amended.
Health and Safety Representatives
Under Section 67 of the Victorian OHS Act, the employer must
allow a representative to attend an approved course on paid time, pay the cost
of the course and must pay any other associated costs.
HSRs and Deputy HSRs must make the request to their employer
to attend an approved course not less than 14 days before the course starts.
While the course is to be chosen by the HSR in consultation
with the employer, an employer cannot reasonably refuse to allow a HSR or a
Deputy HSR to attend the approved course of their choice.
